立法院日前三讀通過「軍事審判法」修正案，承平時期軍人犯罪回歸一般司法機關處理，外界期盼總統府儘快公告施行。總統府副發言人馬瑋國說，馬英九總統已在紐約簽署，最快可望在今（13）日完成相關程序，明日刊登公報公布。
軍審法修訂後，承平時期軍人犯下凌虐部屬、阻撓部屬陳情、殺人、性侵、竊盜等罪，回歸一般司法程序審理。
洪仲丘案因此將移審到一般司法法庭，公告後「馬上生效」，同時司法單位也將成立專業法庭處理軍事案件；至於其他案件由軍法轉移到一般司法，需要5個月左右的作業時間。
馬瑋國表示，總統府已於昨日下午收到立法院送來的咨文，也以最快的速度呈報馬總統和副總統吳敦義。
她說，馬總統已在紐約簽署，將在最短時間送請行政院長江宜樺和國防部長嚴明副署，以完成憲政程序。最快可望於今日完成相關程序，明日刊登總統府公報。
至於馬總統出訪期間如何簽署？馬瑋國表示，依照「公文程式條例」，包括令、呈、咨、函、公告等公文，「必要時得以電報、電報交換、電傳文件、傳真或其他電子文件行之」；此次總統府即以傳真方式處理，以爭取時效。
