新竹何姓婦人前年與結褵20餘年丈夫離婚，離婚後聽聞長年在大陸經商的丈夫早與大陸籍小三外遇產子，她主張丈夫婚外情產子是在婚姻存續中發生，對前夫提出通姦告訴，新竹地檢署今天起訴劉姓男子。

另，何姓婦人也以丈夫外遇行為侵害配偶關係的身分法益，向法院提告求償60萬，新竹地院民事庭審酌雙方財力，認為精神慰撫金以30萬較適當。
